§1 General Provisions

  1. These Regulations ("Regulations") set forth the rules for registration and participation in the openCARDIO Conference – Acute pulmonary embolism challenges and perspevctives("Conference"), which takes place in Warsaw, Poland on November 24-25, 2023.
  2. The organizer of the Conference is the Warsaw Medical University, based in Warsaw, address: Żwirki i Wigury 61 Street, 02-091 Warsaw, having REGON: 000288917 and NIP: 525-00-05-828 ("Organizer" or "WUM"). Promotion Plus Elżbieta Multan-Putur, 05-510 Chylice, 18 Pogodna Street. NIP: 525 199 65 48, REGON: 014999033 ("Executive Organizer") acting on the basis of the Organizer's authorization performs the entrusted tasks related to the organization of the Conference specified in separate agreements.
  3. The provisions of the Regulations are an integral part of the Workshop Participation Application and apply to all participants of the Conference.
  4. The participants of the Conference are persons authorized to issue prescriptions and persons trading in medicinal products within the meaning of Article 2 point 14 and Article 48 of the Law of May 12, 2011. Pharmaceutical Law, in particular cardiologists, internists, physicians of other specialties, PCPs, lecturers who are authorized to issue prescriptions.
  5. The Conference will include scientific and didactic sessions and workshops. intended only for participants of the Conference, referred to in item. 1.4. of the Regulations.

§2 Rules of participation and cancellation of participation

  1. The condition for participation in the Conference is to apply for participation via the application form available on the Conference website www.opencardio.eu. The participation application form should include: name, surname, telephone number, e-mail address, name of the participant's company/organization/institution and read the Regulations, information clause and consent clause.
  2. Registration shall take place upon receipt of an email confirmation from the Executive Organizer to the participant's email address indicated in the participation application form.
  3. Registration can only be done in one's own name
  4. For participation in the Conference, the participant of the Conference referred to in § 1 paragraph 4 item. Regulations will receive educational points in accordance with the rules established by the Medical Chamber.
  5. The Participant may resign from participation in the Conference. Cancellation of Participant's participation in the Conference should be made in writing, to the email address jbm@promotionplus.eu.
  6. The Conference program is made available by the Organizer on the website www.opencardio.eu. The Organizer reserves the right to change the speakers of the Conference without giving any reason. The Conference participant shall not be entitled to compensation from the Organizer or the Executive Organizer in such case.

§3 Responsibilities of the Participant

  1. The participant is required to read and comply with the rules and regulations, as well as comply with the rules and regulations of the facility where the conference will be held.
  2. Participants are forbidden to use the service provided by the organizer within the framework of the conference to provide unlawful content.
  3. The participant undertakes that by his participation in the conference (statements or behavior) he will not violate any rights of third parties. It is forbidden for the participant to utter and present content prohibited by the applicable provisions of Polish and international law, in particular content that is defamatory or violates personal rights and other rights of third parties, pornographic content, content related to the promotion of violence and hatred, drastic content, as well as content generally considered offensive, morally reprehensible, socially inappropriate, offending religious feelings, violating copyright or other rights of others.
  4. 4. In case of violation of the prohibition referred to in item. 3. above, the participant shall be solely responsible for the consequences of such violation. In the event of any claims on this account against the organizer, the participant agrees to indemnify the organizer from any liability, and to intervene in the proceedings in the place of the organizer or as a side intervener, and to pay all costs of the organizer's participation in these proceedings, including the costs of legal representation.

    §4 Technical conditions

  5. Participation in the Conference, in the case of implementation in online form, is possible when, the participant of the Conference has a total of:
    a) a device such as a computer (desktop, laptop), smartphone, tablet with Internet access with a recommended bandwidth of at least 2Mb, with the Organizer stipulating the lack of specific functions on smartphone devices;
    b) updated operating system, understood as installing the latest version of the operating system available on the device in questionb) Internet Explorer, Google Chrome, Firefox, Opera, Safari browser of choice in versions current as of the date of participation in the online conference,
    c) Internet Explorer, Google Chrome, Firefox, Opera, Safari browsers of your choice in versions current as of the date of participation in the online conference, Audio/Video features enabled.
  6. 2. Use of webinar functionality during the Online Conference may be subject to installation of additional Flash software and acceptance of the cookie policy.
  7. additional materials related to the webinar topics may be in the form of PDF, PPTX, DOCX, XLSX files.

§5 Liability

  1. The Executive Organizer and the Organizer shall not be liable for:
    a) incorrectly entered data by the participant of the Conference,
    b) failure to meet the technical conditions referred to in § 4 of the regulations necessary for participation in the Conference in the remote version,
    c) incurred damages and lost profits by the Participant, which are caused by: giving false data by the person making the Registration, actions or omissions of third parties, on which the Executive Organizer and the Organizer had no influence, change of duration, shortening of the Conference or its cancellation due to circumstances for which the Executive Organizer and the Organizer are not responsible.
    d) how the Participant will use the knowledge and skills acquired during the Conference. The Conference Participant uses the content resources provided in the address domain www.opencardio.eu at his/her own risk and responsibility. The Organizer declares that it exercises due diligence in selecting speakers for the Conference in order to ensure the highest possible level of content. At the same time, the organizer stipulates that it is not responsible for the content of the speeches of speakers and other participants of the conference, as well as the possible consequences of following by the listeners of the speeches (including participants) to any advice or positions formulated by the speakers and other participants of the conference.
  2. 2. The organizer shall not be liable for improper performance or non-performance of the contract to the extent caused by force majeure. Force majeure is understood as external events, beyond the control of the parties to the agreement and impossible to predict, such as, in particular, war, fire, epidemics, floods, strikes, disasters, acts of terror.

§6 Complaints

  1. Titles and rights to the content provided in the address domain www.opencardio.eu , logos, graphics, photos, audio and video files and presentations, are vested in the Organizer or a third party, in particular lecturers, Partners, and are protected by law.
  2. The aforementioned designations or materials may not be used and copy without the written consent of the Organizer or the third party holder of the rights.
  3. Copying of materials made available in the address domain www.opencardio.eu sharing of such materials and recordings is illegal and subject to protection in particular under the Act of February 4, 1994 on Copyright and Related Rights.

§7 Intellectual Property

  1. Titles and rights to the content provided in the address domain www.opencardio.eu, logos, graphics, photos, audio and video files and presentations, are vested in the Organizer or a third party, in particular lecturers, Partners, and are protected by law.
  2. The aforementioned designations or materials may not be used without the written consent of the Organizer or the third party holder of the rights.
  3. Copying materials made available in the address domain www.opencardio.eu sharing such materials and recordings is illegal and subject to protection in particular under the Act of February 4, 1994 on Copyright and Related Rights.

    §8 Filming of the Conference, consent to capture and disseminate image

    1. The Executive Organizer stipulates that the course of the Conference may be recorded for documentation and reference purposes.
    2. The participant agrees indefinitely to the free recording and dissemination of his image, recorded during the conference in the form of photographs or video recording.
    3. The consents mentioned in paragraph 2 above are granted for the use of recordings and photographs by the Organizer or entities acting on its behalf in any activity of the Organizer, in particular in business, promotional, advertising, marketing activities.
    4. The consents listed above are not limited in time or territory and apply to all audio-video materials (and thus containing both the participant's image and statements) and photographs with the participant's participation, taken during the conference by the Organizer or an entity acting on its behalf.
    5. The participant agrees to fix and reproduce the photos by any technique, including printing, reprographic, photographic and digital technique, on any medium and in any format, including press, ooh, outdoor media, computer memory, magnetic recording, as well as in multimedia networks, including Internet and intranet type, in particular on-line, as well as by computer printout; without any limitation as to the number of copies or copies, including through public sharing, including transmission through multimedia networks, especially the Internet and intranet, on-line, on-demand communication, including public sharing, as well as sharing in such a way that everyone can have access to the work or its fragment in a place and at a time of their own choosing - especially on the Organizer's websites, in social media and in the Organizer's promotional and information materials.
    6. The participant's image may be used for various forms of electronic image processing, framing and composition, juxtaposed with images of other people, supplemented with accompanying commentary, film and sound recordings may be cut, edited, modified, added to other materials, without obligation to accept the final product, but not in forms that are offensive or generally considered unethical.
    7. The participant shall not have the right to request retouching or other changes to recordings or photos involving the participant, including the removal or modification of any recorded statements of the participant.
    8. The participant has the right to withdraw consent at any time without affecting the legality of the processing carried out on the basis of consent before its withdraw.

    §9 Information clause

    In accordance with the General Data Protection Regulation of April 27, 2016, hereinafter referred to as RODO, we inform you that:
    1. the Administrator of your personal data is the Warsaw Medical University of with its registered office in (02-091) Warsaw, 61 Żwirki i Wigury St.
    2. the Administrator has appointed a Data Protection Supervisor, who can be contacted at e-mail: iod@wum.edu.pl, or at tel: +48 22 57 20320; The Data Protection Supervisor can be contacted on all matters concerning the processing of personal data and the exercise of rights related to data processing.
    3. Warsaw Medical University will process the following personal data: name, email address, telephone number, company/institution/organization name and image.
    4. your personal data will be processed for the purpose of enrollment for participation and organization and conduct of the conference. Purpose and scope of the program at www.opencardio.eu
    5. The legal basis for processing your personal data is Article 6 by law 1 RODO - processing on the basis of consent.
    6. The provision of personal data by you is voluntary, but necessary to participate in the Conference.
    7. Your personal data will be processed on behalf of the data controller by authorized employees only for the purposes referred to in point 4.
    8. Your personal data will be stored for a period of 12 months.
    9. your personal data will be shared with the following external entities: Promotion Plus Elżbieta Multan-Putur, 05-510 Chylice, 18 Pogodna St. NIP 525 199 65 48, REGON 014999033 ("Executive Organizer").
    10. under the terms of the RODO regulations, you have:
      a) the right to access the content of your data,
      b) the right to rectify them when they are inconsistent with the actual state,
      c) the right to erasure, restriction of processing, as well as data portability - in cases provided by law,
      d) the right to object to data processing,
      e) the right to lodge a complaint to the supervisory authority - the President of the Office for Personal Data Protection, if you consider that the processing of your personal data violates the provisions on personal data protection.

    §10 Consent Clause

    The participant agrees to the processing of his/her personal data (in the scope including name and surname, e-mail address, telephone number, name of the company/organization/institution) and dissemination of his/her image by the Warsaw Medical University based in Warsaw 02-091, at 61 Żwirki i Wigury Street, for the purpose of enrollment for participation and organization and conduct of the conference. In addition, I declare that I have been informed that I may withdraw my consent at any time and that the withdrawal of consent does not affect the legality of the processing performed on the basis of consent before its withdrawal.

    §11 Final provisions

    1. If, for reasons beyond the control of the organizer, it will be impossible or difficult to hold the conference in a stationary mode at the designated place and date, the organizer reserves the right to cancel, change the place or date of the conference. In the event that the Conference does not take place for reasons beyond the control of the Organizer or the Executive Organizer, the Executive Organizer will immediately notify the Participants of this fact to the e-mail addresses indicated by them.
    2. In the event that the Conference does not take place for reasons beyond the control of the Organizer or the Executive Organizer, the Participant shall not be entitled to any compensation or refund of any fees, and the Executive Organizer shall immediately notify the Participants of this fact at the e-mail addresses indicated by them.
    3. Any disputes that may arise from participation in the Conference shall be resolved by the court having jurisdiction over the seat of the Executive Organizer.
    4. Submission of the registration application posted on the Conference website implies acceptance of the provisions of the Regulations, as well as compliance with the rules of order and any other arrangements made between the participant of the Conference and the Organizer or the Executive Organizer.
    5. In matters not regulated by the Regulations, the provisions of generally applicable law shall apply.
    6. The Participant undertakes to use true, i.e. factually and legally correct data, including personal data.
    7. Neither the Organizer nor the Executive Organizer shall be liable for Participants' belongings that may be lost, damaged or stolen during the Conference.
    8. the Participants shall bear full financial responsibility for the damage they cause both on the premises where any activities related to the Conference are carried out, as well as in the places of accommodation.
    9. Registration as a Participant of the Conference and application of the Participant in the mode of group registration is tantamount to acceptance of the Regulations.
    10. these Regulations shall enter into force as of the date of their posting on the website www.opencardio.eu The Executive Organizer shall have the right to change the provisions of the Regulations, also due to situations of higher necessity. Amendments shall become effective as of the date of their posting on the website www.opencardio.eu
